ACCEPTANCE OF TERMS

By accessing or using the Consent.sex application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must refrain from using the App. Your continued use of the App constitutes acceptance of any changes to these Terms.

USER ACCOUNT

You may be required to create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use or suspected breach of your account. PPWRK LTD is not liable for any loss or damage arising from your failure to safeguard your account information.

USER CONDUCT

You agree to use the App in compliance with these Terms and all applicable laws and regulations. You may not use the App:

• For any unlawful purpose or in any manner that violates these Terms.
• To exploit, harm, or attempt to exploit or harm others, including minors, in any way.
• To distribute, transmit, or upload any material that is harmful, offensive, or otherwise objectionable.
• To interfere with or disrupt the App, its servers, or networks.

Violation of these rules may result in immediate suspension or termination of your account.

CONTENT AND RECORDINGS

The primary function of Consent.sex is to facilitate the documentation of clear, verbal consent between adults. By using the App:

• You acknowledge and agree that all verbal agreements made using the App may be recorded for verification and accuracy purposes.
• You give explicit consent to the recording process, understanding that it is designed to create a transparent and accountable record of verbal consent.
• Recordings will only be retained if submitted by the user for the purpose of documentation; otherwise, they are permanently deleted to protect user privacy.

Use of Recordings

Recordings submitted by users are stored securely and may only be accessed:

• By the user who submitted the recording.
• In compliance with a legal obligation, such as a court order or valid law enforcement request.
• To investigate potential misuse of the App.

By submitting a recording, you grant PPWRK LTD a limited, non-exclusive right to store and use the recording for the purposes stated above.

COMPLIANCE WITH GLOBAL SEXUAL HEALTH LAWS

Consent.sex is dedicated to fostering safe and consensual interactions and operates in accordance with international standards on sexual health and consent. The App is intended for use by adults who have the legal capacity to give consent. Users must comply with the following guidelines:

1. Age of Consent: Users must be of legal age in their respective jurisdictions to give valid consent. The App is strictly for adults; any attempt by minors to use the App is a violation of these Terms.
2. Voluntary Consent: The App requires clear, affirmative, and voluntary agreement between all parties involved. Any form of coercion, intimidation, or manipulation to obtain consent is strictly prohibited.
3. Legal Capacity: Users must have the legal capacity to consent. This includes ensuring that all parties are mentally and physically capable of understanding the nature and implications of their agreement.
4. Prohibited Activities: The App does not condone or facilitate illegal activities, including but not limited to:

• Human trafficking, exploitation, or any form of sexual abuse.
• Recording without explicit verbal consent from all parties.
• Use of the App for commercial sex work in jurisdictions where it is illegal.

Failure to comply with these laws and guidelines may result in immediate termination of your account and reporting to relevant authorities if necessary.

INTELLECTUAL PROPERTY

All content within the App, including text, graphics, logos, and software, is the exclusive property of PPWRK LTD. It is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any part of the App without express written consent from PPWRK LTD.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

The App is provided “as is” and “as available,” without any warranties of any kind, either express or implied. PPWRK LTD does not warrant that the App will be uninterrupted, error-free, or secure. You agree that your use of the App is at your own risk.

In no event shall PPWRK LTD, its affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the App, even if advised of the possibility of such damages.

CHANGES TO TERMS

PPWRK LTD reserves the right to amend these Terms of Service at any time. We will notify you of any significant changes by updating the ‘Last Updated’ date above and may provide additional notice via email or in-app notification.

GOVERNING LAW

These Terms of Service are governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
